New Minnesota State Law Affecting Paint Purchases and Recycling



What You Should Know About PaintCare – the Minnesota Paint Stewardship Program

On November 1, 2014, a NEW STATE LAW went into effect requiring the establishment of the Minnesota Paint Stewardship Program. This program was not initiated by Hirshfield’s and is required by state law.

The primary goals of the PaintCare Paint Stewardship Program are to decrease paint waste and recycle more post-consumer paint by setting up convenient drop-off sites in the state (more here). Similar programs have been implemented in Oregon, California, Connecticut and Vermont by PaintCare Inc., a non-profit created by the the American Coatings Association.

The Minnesota Paint Stewardship Program will be funded by a fee on each container of architectural paint sold in the state. The program will set up drop-off sites throughout the state where residents and businesses, including trade painters, will be able to take most leftover paint for recycling, free of charge.

How does this affect the Painting Contractor?
The paint stewardship fee must be added to the wholesale price of all architectural paint sold in Minnesota regardless of its point of manufacture. The law also requires that each distributor and retailer include the PaintCare Recovery Fee with their sale price.

The benefit to the contractor is the added convenience of using designated paint stores like select Hirshfield's for recycling paint products included in the program.

State Fees collected beginning November 1, 2014
All sellers of paint in Minnesota are required, beginning November 1, to collect the PaintCare Recovery Fee at the time of purchase. The Recovery fee varies by container size: fees range from $0.35 (larger than a half-pint to less than a gallon) to $0.75 per gallon and $1.60 for each container larger than a one gallon can up to a five gallon bucket.

NOTICE TO TRADE PAINTERS
Trade painters may pass the PaintCare fee on to their respective customers in order to recover the fee they pay on the affected products. For your convenience, Hirshfield’s, Inc. will display this fee as a separate “PaintCare Recovery Fee” line item on our invoices.

IMPORTANT: When estimating jobs, you should take the fee into account by checking with your supplier to make sure the quotes for paint products include the fee. You should also let your customers know that you will be including this fee in your quotes. This applies to any jobs where product may be purchased after November 1, 2014.

So be aware that any paint purchased in Minnesota effective November 1, 2014, no matter which paint store, hardware store or other store you visit, will be subject to a fee supporting the PaintCare Minnesota Paint Stewardship Program.

What Products Are Covered for Drop Off?
Architectural paints (“Program Products”) are defined as interior and exterior architectural coatings sold in containers of 5 gallons or less. However, they do not include aerosol products (spray cans), industrial maintenance (IM), original equipment manufacturer (OEM) or specialty coatings. Refer to Information for Trade Painters FACT SHEET September 2014 (available at www.paintcare.org) for additional information.

Program Products:
(These products have fees and are accepted at drop-off sites in Minnesota)

  • Exterior and interior house paints: latex, acrylic, water-based, alkyd, oil-based, enamel (including textured coatings)
  • Deck coatings, floor paints (including elastomeric)
  • Primers, sealers, under-coaters
  • Stains
  • Some shellacs, some lacquers, varnishes, urethanes (single component)
  • Waterproofing concrete/masonry/wood sealer and repellents (not tar or bitumen-based)
  • Metal coatings, rust preventatives
  • Field-marking and lawn paints

Non-Program Products:
(These products are not accepted at drop-off sites in Minnesota)

  • Paint thinners, mineral spirits, solvents
  • Aerosol paint (spray cans)
  • Auto and marine paints
  • Art and craft paints
  • Caulking compounds, epoxies, glues, adhesives
  • Paint additives, colorants, tints, resins
  • Wood preservatives (containing pesticides)
  • Roof patch and repair
  • Asphalt, tar and bitumen-based products
  • 2-component coatings
  • Deck cleaners
  • Traffic and road marking paints
  • Industrial Maintenance (IM) coatings
  • Original Equipment Manufacturer (OEM) (shop application) paints and finishes

Program begins NOVEMBER 1, 2104. Due to potential heavy demand at the outset of the program, qualifying products (defined above) up to 5 gallons can be brought to one of the Hirshfield's stores listed and must be checked in by a Hirshfield’s sales associate. No more than 5 gallons of Program Product may be dropped-off at one time. As the program develops, this restriction may ease. If your company has specific needs, please contact your Hirshfield’s sales representative.
